Terms of Service

1. Acceptance of Terms

Vashana is a product and service operated by Alvesta Systems AS, a company registered in Norway (Org. nr. 936 927 548) ("we," "our," or "us").

By accessing and using Vashana's services ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms incorporate our Privacy Policy, Data Processing Agreement, Sub-processor list, Refund & Cancellation Policy and Cookie Policy.

2. Description of Service

Vashana provides a Software as a Service (SaaS) platform for website creation, hosting, and management. Our services include but are not limited to:

2.1 Service Features

• AI-assisted website creation, editing and content generation
• A visual site editor and design-system tools
• Website hosting on Vashana subdomains and on custom domains
• Domain search and registration through our registrar partner
• File and image hosting, and AI image generation
• Site import, export, backup and restore
• Password protection for sites, folders and files, and QR codes
• Translation of a published site into additional languages
• An AI chat assistant you can add to your published site
• A booking engine for rentals, appointments and capacity-based departures
• E-commerce integrations with third-party checkout providers
• A REST API, API keys, and an MCP server for programmatic and AI-agent access

Features differ by plan and by the type of site you create, and we may change what a plan includes on notice.

2.2 AI-Generated Content Disclaimer

Vashana uses artificial intelligence to assist with website creation, content generation, and image generation. AI-generated output may be inaccurate, incomplete, or unsuitable for your intended purpose. You are solely responsible for reviewing, verifying, and editing all AI-generated content before publishing or relying on it.

This applies with particular force to the site chat assistant, which answers your visitors in real time, in your name, without a review step. If you enable it, you are responsible for what it says on your site, including any statement it makes about your prices, availability, or terms.

Vashana makes no representations or warranties regarding the accuracy, reliability, or appropriateness of any AI-generated content. We shall not be liable for any damages, losses, or claims arising from your use of or reliance on AI-generated content.

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use this Service. By using this Service, you represent and warrant that you meet this age requirement.

4. Acceptable Use Policy

You agree not to use the Service to:

• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Violate any local, state, national, or international law or regulation
• Infringe upon or violate the rights of any third party, including intellectual property rights
• Distribute spam, malware, viruses, or any other malicious code
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service for phishing, scamming, or fraudulent activities
• Sell, rent or advertise goods or services you are not lawfully entitled to sell, rent or advertise
• Take payments for goods or services you do not intend or are not able to supply
• Host content that promotes violence, discrimination, or illegal activities
• Resell or redistribute the Service without authorization
• Access the Service if you are, or are employed by or acting on behalf of, a direct competitor of Vashana, for the purpose of competitive analysis, benchmarking, or building a competing product or service

We reserve the right to remove any content that violates these terms and to suspend or terminate accounts engaged in prohibited activities.

5. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Vashana and its licensors. The Service is protected by copyright, trademark, and other laws.

You retain ownership of content you create using our Service, but grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute such content as necessary to provide the Service.

6. Payment Terms and Pricing

This section is about what you pay us. What your own customers pay you is covered by Section 7.

Certain features of the Service require payment of fees. All prices are displayed in USD unless otherwise specified. By subscribing to a paid plan, you agree to pay all applicable fees.

6.1 Billing

• Subscription fees are billed in advance on a monthly or annual basis
• Payment is processed securely through FastSpring, our merchant of record
• You authorize us to charge your payment method for recurring fees
• Failed payments may result in service suspension

6.2 Price Changes

We reserve the right to change our pricing at any time. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.

7. Bookings, Payments and Sales on Your Sites

Vashana lets you take bookings and sell goods and services through the sites you build. This section governs that, and its central point is short: those transactions are between you and your customer, and Vashana is not a party to them.

7.1 You are the seller

• You are the seller, the renter-out or the service provider for everything sold, rented or booked through your site, and the merchant of record for it.
• Vashana never holds, receives, transmits or disburses your customers' money. It settles directly into your own account with your own payment provider, under your own agreement with that provider.
• Vashana is not a bank, payment institution, payment service provider, e-money issuer, escrow agent or money transmitter, and does not act as your agent, broker or intermediary for collecting payment.
• We take no commission and no share of what you sell. What we charge you is the subscription in Section 6.

7.2 Your payment provider is yours

Taking payments requires your own merchant agreement with a payment provider we support. You are responsible for obtaining and keeping that agreement, for the accuracy of the credentials you connect to Vashana, and for complying with that provider's rules. Their fees, reserves, holds, settlement timetables, chargeback rules and acceptable-use policies are between you and them.

By connecting a provider you instruct us to call its API on your behalf using those credentials. We do not warrant that any provider will approve you, keep you approved, settle on any timetable, or remain available; an outage, delay, freeze, reversal or account closure on their side is a matter between you and them.

7.3 What we are not responsible for

Without limiting Sections 13 and 14, and to the fullest extent permitted by law, we are not responsible or liable for:

• The completion, correctness, timing or settlement of any payment, refund, deposit, capture, release or payout
• Chargebacks, disputes, reversals, fraud, or non-payment by your customers
• Refunds you owe, cancellations you make, deposits you claim or release, and any dispute about them
• Whether your goods or services are delivered, and the conduct of your customers — including no-shows, late returns, and damage to or loss of anything you rent out
• Taxes. Calculating, collecting, reporting and remitting VAT/MVA, sales tax or any other tax on your sales is yours alone. We do not act as a tax collector or deemed supplier for your transactions.
• Insurance. We neither provide nor arrange insurance of any kind — for you, for your customers, or for the items you rent out — and nothing in the Service is an offer of insurance or a warranty against loss.
• Regulatory compliance for what you sell — licensing, permits, age limits, safety obligations, consumer protection, distance-selling and cancellation rights, and product or service liability
• Identity verification of your customers, or their creditworthiness. Where a payment provider supplies identity information it does so under your agreement with that provider, and we pass it on without independently verifying it

7.4 The suggested rental agreement is a suggestion

Where the booking engine asks your customer to accept an agreement before paying, Vashana supplies suggested wording as a convenience. It is a starting point, not legal advice. It has not been reviewed by a lawyer in any jurisdiction, and rules on liability caps, deposits, cancellation and consumer rights vary by country and by industry.

That agreement is between you and your customer, and it is yours. You are responsible for its content — whether you keep our suggestion, edit it, or replace it with your own terms — and for having it checked for your industry and your country. Vashana is not a party to it, gives no advice about it, and makes no representation that it is valid, enforceable, or sufficient for your business.

7.5 Your customers are your customers

We have no contractual relationship with the people who buy from or book with you. You are responsible for your own terms of sale, cancellation and refund policy, privacy notice and consumer-law obligations towards them, and for handling their questions and complaints. Where we process their personal data it is on your behalf and as your processor, on the terms of our Data Processing Agreement. If one of your customers contacts us directly we will refer them to you rather than act on your behalf.

7.6 Suspension of these features

We may suspend the booking or commerce features on your account, without liability to you, where we are required to by law, where a payment provider requires it, or where we reasonably believe they are being used for fraudulent or unlawful sales.

8. Domain Registration Services

Vashana offers domain registration services through our partnership with Tucows Domains Inc. (operating as OpenSRS). When you purchase a domain through Vashana, you agree to the following terms in addition to the Tucows Master Domain Registration Agreement.

8.1 Domain Ownership

When you purchase a domain through Vashana:

• You are the legal owner (registrant) of the domain name
• Vashana acts solely as a reseller and intermediary, not as the domain owner
• You have full rights to transfer your domain to another registrar at any time
• Domain registration is subject to ICANN policies and the applicable registry's terms

8.2 Registrant Information

Domain registration requires accurate contact information as mandated by ICANN:

• You must provide accurate and complete registrant information (name, address, email, phone)
• You agree to keep this information current and accurate
• Providing false or inaccurate information may result in domain suspension or cancellation
• Your information will be shared with the domain registry and may appear in WHOIS records

8.3 Domain Renewal and Expiration

You are solely responsible for renewing your domain registration:

• We will send renewal reminders via email before expiration
• If you fail to renew, your domain will expire and you may lose all rights to it
• Expired domains may be deleted, sold to third parties, or retained by the registrar
• A grace period of up to 40 days may be available for expired domain recovery, but additional fees apply
• We are not responsible for any loss of domain due to non-renewal

8.4 Domain Transfers

You have the right to transfer your domain away from Vashana at any time:

• We will provide the EPP/authorization code upon request
• Standard ICANN transfer lock periods apply (60 days after registration)
• We will not charge punitive fees for transferring away

8.5 Domain Disputes

Domain registrations are subject to dispute resolution policies:

• ICANN's Uniform Domain Name Dispute Resolution Policy (UDRP)
• Uniform Rapid Suspension (URS) procedure
• Applicable registry dispute policies

You represent that your domain registration does not infringe on the rights of any third party and will not be used for unlawful purposes.

8.6 Non-Refundable

All domain registration and renewal fees are non-refundable, even if your domain is suspended, cancelled, or transferred before the end of the registration term. Please refer to our Refund Policy for complete details.

8.7 DNS and Availability

Where you point a domain at Vashana — one you bought through us or one you already own — we create and maintain the DNS records needed to serve your site, and you may change or move them at any time. You are responsible for any DNS records you manage yourself and for anything else that depends on that domain, including email.

To the fullest extent permitted by law, we are not liable for: a domain becoming unavailable, or its price changing, between the moment you search for it and the moment the registry confirms the order; a registry's or registrar's decision to refuse, suspend, delete, lock or transfer a domain; suspension arising from registrant verification; DNS propagation delays or downtime; loss of traffic, email or search ranking following a DNS or domain change; or the acts and omissions of the registrar, the registry or ICANN.

9. Cancellation and Refunds

All fees are non-cancellable and non-refundable. You may cancel your subscription at any time, but no refunds or credits will be issued for any unused portion of your subscription period. You will retain access to paid features until the end of your current billing period.

We encourage you to evaluate Vashana thoroughly on the free plan before committing to a paid subscription. Please refer to our Refund & Cancellation Policy for complete details.

This section is about your Vashana subscription. Refunds to your customers are yours to make, on your own terms — see Section 7.

10. Service Availability and Modifications

We strive to maintain 99.9% uptime for our Service, but we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice. We may also impose limits on certain features and services.

Scheduled maintenance will be announced in advance when possible. Emergency maintenance may occur without prior notice.

We do not warrant that your published site, its booking pages or its checkout will be available at any given moment, and we are not liable for sales, bookings or revenue lost while any part of the Service is unavailable.

11. Data and Content

11.1 Your Content

You are solely responsible for the content you create, upload, and publish through our Service. You represent and warrant that you have all necessary rights to your content and that it does not violate any laws or third-party rights.

11.2 Backups

While we implement regular backup procedures, you are responsible for maintaining your own backups of important content. We are not liable for any data loss.

11.3 Your Customers' Data

For personal data belonging to the people who visit, book with or buy from your sites, you are the controller and we are your processor. The terms are in our Data Processing Agreement, which applies automatically and which sets out how long booking evidence such as accepted agreements and check-in photographs is retained before deletion.

12. Third-Party Services

Our Service integrates with or relies on third-party services including:

• Fly.io: Application and database hosting
• Cloudflare: Object storage (R2), edge serving, DNS and CDN
• Supabase: Authentication services
• OpenAI: AI content and image generation
• Resend: Transactional email
• Sentry and Grafana Cloud: Error monitoring and log aggregation
• FastSpring: Subscription billing for Vashana plans (merchant of record)
• OpenSRS (Tucows Domains Inc.): Domain registration services
• Vipps MobilePay and Stripe: Payment providers for bookings taken on your sites, on your own merchant agreement
• Snipcart and Stripe: Checkout providers for shops on your sites, on your own account
• Plausible: Cookieless analytics, on our own marketing site and as an optional integration on yours

We are not responsible for the availability, functionality, or security of these third-party services. Your use of such services is subject to their respective terms and conditions.

The current list of third parties that process personal data on your behalf, and where each one processes, is maintained at /legal/sub-processors.

13. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VASHANA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

WE DO NOT PROVIDE LEGAL, TAX, ACCOUNTING, INSURANCE OR REGULATORY ADVICE. ANY AGREEMENT TEMPLATE, POLICY TEXT OR SUGGESTED WORDING THE SERVICE GENERATES OR SUPPLIES IS PROVIDED AS A CONVENIENCE, WITHOUT WARRANTY OF VALIDITY, ENFORCEABILITY OR FITNESS FOR YOUR BUSINESS OR JURISDICTION.

14. LIMITATION OF LIABILITY

IN NO EVENT SHALL VASHANA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

WITHOUT LIMITING THE FOREGOING, VASHANA SHALL HAVE NO LIABILITY FOR: ANY TRANSACTION BETWEEN YOU AND YOUR CUSTOMER; ANY AMOUNT PAID, PAYABLE, REFUNDABLE, HELD, CAPTURED, RELEASED, CHARGED BACK OR LOST ON YOUR SITES; THE ACTS OR OMISSIONS OF A PAYMENT PROVIDER, REGISTRAR, REGISTRY OR OTHER THIRD PARTY; ANY TAX, DUTY OR LEVY ON YOUR SALES; OR THE LOSS, DAMAGE, THEFT OR NON-RETURN OF ANY ITEM YOU RENT OUT.

VASHANA'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO VASHANA FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for fraud, or under any mandatory consumer-protection law that applies to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless Vashana and its licensors, employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or a breach of these Terms.

This includes, without limitation, any claim brought by one of your customers, by a payment provider, or by a tax or regulatory authority, arising out of a booking, rental, sale or refund made through your site.

16. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to a breach of these Terms.

Upon termination:

• Your right to use the Service will cease immediately
• You may request an export of your data within 30 days
• Your content may be deleted after 30 days
• No refunds will be provided for the remaining subscription period unless required by law
• Bookings already taken remain your obligation to your customers; we are not responsible for honouring, refunding or communicating them

17. Governing Law and Dispute Resolution

These Terms shall be interpreted and governed by the laws of Norway, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration, except where prohibited by law.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

19. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect via email or notification in the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
